SANCTIONS CIVIL ENFORCEMENT AUTHORITY
The Gibraltar Regulatory Authority (the "Authority") is the designated competent authority responsible for the enforcement of civil sanctions in Gibraltar. In this capacity, the Authority acts as the Sanctions Civil Enforcement Authority (SCEA) and is responsible for carrying out all functions, duties and obligations conferred under the Sanctions Act 2019 (the "Act").
What Are Sanctions?
Sanctions are legally binding restrictive measures imposed by His Majesty's Government of Gibraltar, by international bodies such as the United Nations, the European Union, and the Government of the United Kingdom. These measures are designed to restrict or prohibit dealings with specified individuals, entities, states, governments, sectors or assets in support of national security objectives, international peace and security, compliance with international law, and wider foreign policy goals.
Sanctions are implemented through domestic and international legal frameworks, including legislation, executive powers and international agreements, and are enforced by competent authorities such as regulators, customs authorities, law enforcement agencies and other public bodies.
Types of Sanctions
Sanctions may take a variety of forms and can apply to both legal persons (such as companies and organisations) and natural persons (individuals), as well as states, governments, economic sectors and strategic resources.
Restrictive measures may include:
- Asset freezes
- Prohibitions on making funds or economic resources available
- Trade restrictions and embargoes
- Shipping and maritime restrictions
- Aircraft and aviation restrictions
- Immigration measures and travel bans
- Sector-specific economic restrictions
The Role of the SCEA
As Gibraltar's civil sanctions enforcement authority, the SCEA promotes compliance with applicable sanctions regimes and exercises its statutory powers to investigate and address breaches of sanctions requirements. Through its regulatory and enforcement functions, the SCEA supports the effective implementation of sanctions measures and helps safeguard the integrity of Gibraltar's financial and economic system.
